GAYDAR.US DISCLAIMER AND TERMS & CONDITIONS

By registering with Gaydar.us and becoming a member, you AGREE to the following:

1. You are an adult of 18 (eighteen) years of age or older. You also agree that you have read these terms and understand that Gaydar.us personals may contain adult content and that certain profiles may contain explicit adult orientated pictures. By entering a tick alongside the "I accept the Terms of use and confirm that I am at least 18 years old.", and pressing the 'Continue' button, you register as a Member and accept the terms and conditions described below applicable to your use of our service provided by Gaydar.us.

2. As an adult you are solely responsible for any information contained in your Profile and all of your communications with other Gaydar.us Members (the "Members"). If you choose to publish a Profile, then it will be published on other sites throughout the Gaydar.us network and promoted by Gaydar.us to other members and potential members via email newsletters and internet promotions. Gaydar.us does not, nor can it practically, monitor or control the use made of its Site by Members. Accordingly you agree to accept sole responsibility for the legality of your actions under all applicable laws. Each other Member is also bound by this User Agreement and agrees to accept sole responsibility for the legality of his actions under his applicable laws. Gaydar.us accepts no responsibility for the legality of the actions of any of its Members.

3. In the case of Profiles, Gaydar.us may hide the Profile if it is judged offensive until the offensive portion is amended. Without limiting any other remedies, Gaydar.us may remove all or part of a Profile posted to its site if Gaydar.us receives a direction, demand or request to do so from any government department or agency; or at any other time, with or without cause, in Gaydar.us’s absolute discretion.  Gaydar.us reserves the right to refuse registration or to cancel such a registration at its own discretion. Gaydar.us will have no liability to you if it removes all or part of a Profile for any reason, and you waive all rights you may have had against Gaydar.us in respect of such conduct. 

4. Gaydar.us is not responsible for ensuring that Members follow the terms and conditions notwithstanding these terms and conditions outline behavior that is unacceptable on the service; and under no circumstances is it liable to a Member for any incidental consequential or indirect damages arising out of the use of the Gaydar.us service. In addition, it disclaims all liability to the full extent permitted by law, regardless of the form of action, for the acts or omissions of other Members or users. Nevertheless, nothing in this User Agreement is intended to limit or exclude any liability on the part of Gaydar.us where and to the extent that applicable law prohibits such exclusion or limitation. If you do not notify Gaydar.us within 12 months of the relevant conduct in respect of which the rights, actions, suits, proceedings or claims have arisen, then, to the extent permitted by law, you agree that you release and discharge Gaydar.us from all rights, actions, suits, proceedings and claims which, but for this clause, you may have had against Gaydar.us.

5. Gaydar.us discloses to you that there are risks of dealing with Internet users based in other countries, underage persons or people acting under false pretence or with some other criminal purpose.  User authentication on the Internet is difficult. Accordingly, Gaydar.us cannot and does not confirm that each Member or user is who he or she claims to be. Therefore, you must be careful in dealing with other Members or users.

6. Some of the postings or content may contain strong language, sexual content, images and explicit copy of an adult or controversial nature. You agree that this material does not offend you in any way, form or manner.

7. You do not live in a Country or City which does not allow you to obtain or view sexually explicit material.

8. Certain content on the Gaydar.us site such as LIVE CAMS is from 3rd parties and Gaydar.us is in no way responsible for the content of these sites.  Additionally, Malebox arranges for your access to these sites as a paid Malebox member.  Access to these sites is available ONLY from within Gaydar.us and not directly from the 3rd party site URL's. 

9. Member profiles may not be used to solicit goods or services or publish any material containing advertising without the written consent of Gaydar.us.

10. Gaydar.us does not have any obligation to remove any such items which you may find offensive.

11. The material which is contained herein is for your own personal use and will not be distributed in any form or used in a commercial or professional manner.

12. With the users consent, Gaydar.us reserves the right to use the email addresses provided from time to time.

13. Gaydar.us will use reasonable efforts to provide the service selected by Members through the registration process solely for the Members own use.

14. Gaydar.us maintains the rights to suspend, discontinue or change any information at any time, as it deems necessary. This includes the availability of certain features.

15. Members shall not interfere with another’s enjoyment of the site and may not discriminate against any person based on race, ethnicity, gender, disability, religion, sexual orientation or any other preferences.

16. A password is allocated to Members upon registration and it is the responsibility of the Member to maintain the security of such a password.

17. The contents of this site are protected by copyright, owned, and controlled by Gaydar.us.

18. Gaydar.us is in no event liable to you for any damages of any kind. Including, but not limited to, compensatory damages, loss of profits, lost data of any form or special, incidental, indirect, consequential or punitive damages of any kind whether based on breach of contract or warranty, negligence, product liability or otherwise.

19. The laws of the State of Nevada in the United States of America, irrespective of your country of residence govern this agreement. If any part of this agreement is found by a court of law to be unenforceable, then the remainder of this agreement continues in force. The agreement constitutes the entire agreement between the parties.

By submitting an application for Membership the user states that he or she irrevocable accepts this Disclaimer and Terms and Conditions, entirely. The user further states that he or she has read these terms and conditions and is in full agreement of the contents.  Gaydar.us has the right to amend the terms and conditions at any time by posting the amended terms on its Site. You and all other Members will be bound by the amended terms from that time.
